Teacher - Terms of use.
In order for Axcis Education to start providing any work finding services to you, we must first obtain your agreement to the terms which apply between Axcis Education (Employment Business) and you the work seeker.
If providing permanent and fixed term work finding services, Axcis Education are acting as an employment agency. When providing temporary work opportunities, Axcis Education are acting as an employment business.
These terms will remain in place until you have chosen and signed up with a payment provider. Your payment provider will then send their terms over to you which will supersede your terms with Axcis. The same applies if you subsequently sign a permanent contract of employment with the hirer.
When on a temporary assignment, where Axcis Education is acting as an employment business, you will be engaged under a contract for services.
We will endeavour to find work for you as a teacher or a support assistant as selected during the registration process. The work seeker shall not be obliged to accept any assignment offered by the Employment Business.
If, before or during an assignment or during the relevant period, the hirer wishes to engage the work seeker directly or through another employment business, the work seeker acknowledges that the employment business will be entitled either to charge the hirer a transfer fee or to agree a period of extended hire with the hirer at the end of which the work seeker may be engaged directly by the hirer or through another employment business without further charge to the hirer. In addition the employment business will be entitled to charge a transfer fee to the hirer if the hirer introduces the work seeker to a third party (other than another employment business) who subsequently engages the work seeker, directly or indirectly, before or during an assignment or within the relevant period.
For the purpose of these terms, "Relevant Period” means the later of (a) the period of 8 weeks commencing on the day after the last day on which you worked for the hirer having been supplied by the employment business; or (b) the period of 14 weeks commencing on the first day on which you worked for the hirer having been supplied by the employment business or 14 weeks from the first day of the most recent assignment where there has been a break of more than 6 weeks (42 days) since any previous assignment.
The employment business will pay the work seeker in respect of work done, whether or not it is paid by the hirer in respect of that work. The frequency of payment is on a weekly basis, one week in arrears.
The work seeker, hirer or employment business can cancel a booking at any time but as an employment business we ask that the work seeker gives us as much notice as possible so that suitable cover can be arranged. If the employment business or hirer needs to cancel a booking then we too will give as much notice as possible.
You will be paid at a rate of no less than national minimum wage / national living wage dependant on your age, the precise rate will be discussed within the context of each assignment.
You will be entitled to statutory minimum holiday entitlement of 5.6 weeks pro rata. Your holiday pay is included as an enhancement to your basic rate of pay. The annual leave year will be determined by your payment provider. This will either follow the calendar tax year (1st April – 31st March) or a calendar year from the date you first start work.
No variation or alteration to these terms shall be valid unless the details of such variation are agreed between the employment business and the work seeker and set out in writing and a copy of the varied terms is given to the work seeker no later than 5 business days following the day on which the variation was made stating the date on or after which such varied terms shall apply.
